SPC holds lecture on safeguarding development of new quality productive forces with high-level IP case adjudication

The Supreme People's Court (SPC) held on March 22 the second lecture of its judge forum themed on contributing judicial wisdom to accelerating the development of new quality productive forces.


Deputy Chief Judge of the SPC's Intellectual Property Court He Zhonglin gave a comprehensive introduction of the court's main work and achievements in handling with appeals related to intellectual property since its establishment five years ago, focusing on promoting the modernization of the philosophy, mechanism, system and management of adjudication work. He also shared the IP court's specific measures in guiding lower-level courts on and managing adjudication work.


The IP court will take it as its own responsibility to accelerate the development of the new quality productive forces, and strive to build China into a preferred venue for international IP litigation, contributing more Chinese wisdom to global IP governance, he said.


New plant varieties are closely related to promoting the development of new quality productive forces in the seed industry. Luo Xia, who has nearly 20 years of judicial experience in handling IP cases in seed industry, shared her thoughts on self-improvement and team leadership as a judge specializing in IP cases in seed industry and presiding judge of collegiate panels on such cases.


Crop breeding as a high-threshold field decides that variety rights cases in this area require a high level of specialization, and there is a lack of judicial precedence to refer to. "If you work hard enough, you will eventually harvest regardless how unpopular and niche the field is," Luo said.


Judge Zhang Xinfeng talked about his experience in adopting the Fengqiao model in dispute resolution by sharing the IP cases he handled, which demonstrated the significance of substantive dispute resolution in the modernization of governance capacity.


Judge Kong Liming took a Standard Essential Patent case and an open-source software case as examples and shared his practices and experiences in handling foreign-related cases to enhance the international influence of China's IP adjudication, serve the country's innovation-driven development strategy, and protect the legitimate rights and interests of litigants in accordance with the law.


Over 180 court staff workers attended the lecture. The SPC's leadership, including the president, Zhang Jun, also attended the event.
